Agreement to Terms
By accessing or using Pepperoni Booking, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our service.
Language
These Terms of Service are provided in English only. In the event of any discrepancy between the English version and any translation, the English version shall prevail. Any translations are provided for convenience only and do not modify the English language version.
User Eligibility
By using Pepperoni Booking, you confirm that:
You are at least 18 years old (or the age of majority in your jurisdiction)
You have the legal authority to enter into this agreement
If acting on behalf of a business, you have the authority to bind that business to these terms
You will use the service only for lawful business purposes
The information you provide is accurate and complete
Business Use Only: This platform is designed for business-to-business use by studio owners and operators. It is not intended for consumer or personal use.
Free Trial Terms
Trial Notice: Pepperoni Booking offers a free trial period. Trial features and limits are subject to change as the platform evolves.
Trial Access
Free trial access is subject to approval and may be limited to a set number of studios.
Trial Duration
The free trial is time-limited. After the trial period, a paid subscription is required to continue using the platform.
Feature Availability
Features may be modified or updated without notice as we continue to improve the platform.
Feedback and Suggestions
Ownership of Feedback
Any feedback, suggestions, ideas, or other submissions you provide about the platform ("Feedback") shall become the sole property of Pepperoni Booking. You hereby assign all rights, title, and interest in and to such Feedback to Pepperoni Booking.
To the extent any such assignment is not legally effective, you grant Pepperoni Booking a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback.
No Compensation: You agree that you will not receive any compensation for Feedback, even if we incorporate your suggestions into our products or services.
Account Termination
We May Terminate
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons may include:

- • Conduct harmful to users or platform
- • Law enforcement requests
- • Extended inactivity
- • Technical or security issues
You May Terminate
You may terminate your account at any time by contacting us. Upon termination:
- • Your access will be revoked
- • Data deleted within a reasonable period after termination
- • You may request a copy of your data before deletion
Service Modifications
Right to Modify
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. This includes adding, changing, or removing features, changing service limitations, modifying the user interface, and updating technical requirements.
Right to Discontinue: We may discontinue the entire service at any time. If we permanently discontinue the service, we will make reasonable efforts to provide advance notice and give you an opportunity to request a copy of your data before service termination.
No Liability: We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

You may NOT:

- ✕Remove or alter any copyright, trademark, or proprietary notices
- ✕Use our service for any unlawful purpose or to violate any laws
- ✕Interfere with or disrupt the service or servers
Enforcement: Violation of these terms may result in immediate termination of access, legal action, and claims for damages including attorney fees.

Provide accurate and current information when creating your account and using the service.

Maintain the security of your account credentials and notify us of any unauthorized use.

Comply with all applicable laws and regulations in your use of the service.
Limitation of Liability
Disclaimer
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall Pepperoni Booking be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to: loss of revenue, loss of profits, loss of business or anticipated savings, missed bookings, lost clients, loss of data, or loss of goodwill — whether or not Pepperoni Booking has been advised of the possibility of such damages.
You acknowledge that Pepperoni Booking is a booking management tool and is not responsible for the outcome of your studio's operations, including class attendance, client retention, revenue performance, or any business decisions made based on information provided by the service.
No Uptime Guarantee: We do not guarantee that the service will be available at all times or without interruption. The service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We are not liable for any loss or damage resulting from service downtime or unavailability.
Data Accuracy: While we strive to maintain accurate data within the platform, you are solely responsible for the accuracy of information you enter, including class schedules, booking details, client records, and capacity settings. We are not liable for any errors, overbookings, scheduling conflicts, or other issues arising from inaccurate or incomplete data input by you or your staff.
No Professional Advice: The service, including any analytics, reports, or insights provided, is for informational purposes only and does not constitute business, financial, legal, or professional advice. You should not rely solely on the service for making business decisions.
Payment Processing: Where the service includes payment collection features, Pepperoni Booking acts solely as an intermediary facilitating transactions between you and your clients through third-party payment processors. We are not responsible for failed, delayed, or disputed transactions, chargebacks, refund disputes, or any loss of revenue resulting from payment processing issues. You are solely responsible for your pricing, refund policies, and financial relationship with your clients.
Email and Notification Delivery: The service sends automated emails on your behalf, including booking confirmations, cancellation notices, and reminders. These emails are delivered through third-party email providers and are subject to factors beyond our control, such as spam filters, recipient server availability, and incorrect email addresses provided by your clients. We are not liable for any consequences arising from emails that are delayed, filtered, or not delivered, including missed appointments, scheduling confusion, or lost bookings.
Liability Cap: To the maximum extent permitted by applicable law, Pepperoni Booking's total aggregate liability arising out of or in connection with these Terms or your use of the service shall not exceed the total fees paid by you to Pepperoni Booking in the one (1) month preceding the event giving rise to the claim, or sixty euros (€60), whichever is greater.
Time Limitation on Claims: Any claim arising out of or related to these Terms or your use of the service must be filed within one (1) year after the event giving rise to the claim. Any claim not filed within this period is permanently barred.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
Indemnification
Your Responsibility
You agree to defend, indemnify, and hold harmless Pepperoni Booking, its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney fees) arising from:
- •Your use or misuse of the platform
- •Your violation of these Terms
- •Your violation of any third-party rights, including privacy rights of your clients
- •Any content you input into the platform
- •Your business activities conducted through the platform
Client Data Responsibility
Your Role as Data Controller
You are the data controller for any personal data of your clients that you collect, store, or process through the platform. Pepperoni Booking acts as a data processor on your behalf, processing client data only as necessary to provide the service.
Your Obligations: You are responsible for ensuring that you have a lawful basis for collecting and processing your clients' personal data, including obtaining any necessary consents. You are responsible for responding to data subject requests from your clients (such as access, deletion, or correction requests) and for complying with applicable data protection laws in your jurisdiction.
Our Role: We will process your clients' data in accordance with your instructions and our Privacy Policy. We are not responsible for how you use, share, or manage your clients' personal data, or for any claims arising from your clients in connection with your data handling practices.
Third-Party Links and Services
External Links
Our service may contain links to third-party websites, services, or integrations that are not owned or controlled by Pepperoni Booking. The inclusion of any link does not imply endorsement, approval, or recommendation by us.
We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Pepperoni Booking shall not be responsible or liable for any damage or loss caused by your use of any such content, goods, or services.
We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit or use.
Dispute Resolution
Informal Resolution First
Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally first. Most concerns can be resolved quickly through direct communication.
Individual Claims Only
You agree to resolve disputes only on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative actions.
Exceptions: This does not apply to intellectual property disputes or claims for injunctive relief where individual resolution would be inadequate.
Governing Law
Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Exclusive Jurisdiction: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, the Netherlands.
International Users: If you access the service from outside the Netherlands, you are responsible for compliance with local laws to the extent they apply to your use of the service.
General Provisions
Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment without consent shall be void.
Pepperoni Booking may freely assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without notice or your consent, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
Survival
The following sections shall survive any termination or expiration of these Terms: Intellectual Property Rights, Feedback and Suggestions, Limitation of Liability, Indemnification, Client Data Responsibility, Dispute Resolution, Governing Law, Aggregate Data Rights, and this Survival clause. All accrued rights and obligations shall also survive termination.
Aggregate Data Rights
Pepperoni Booking may collect, use, and disclose anonymized, aggregated data derived from your use of the service for any purpose, including product improvement, benchmarking, analytics, and marketing (e.g., "X% of studios use feature Y"). Such data will not identify you or your clients individually.
This right survives termination of your account. Anonymized, aggregated data is not considered personal data under applicable data protection laws.
Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pepperoni Booking regarding the use of the service. These Terms supersede any prior agreements or communications.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by Pepperoni Booking.
Changes to Terms
We reserve the right to modify these terms. For material changes, we will provide at least 30 days' advance notice by email and by posting the updated Terms on this page. If you do not agree with the changes, you may terminate your account before the changes take effect.
Non-material changes (such as formatting or clarifications that do not affect your rights) may take effect immediately upon posting. Your continued use of the service after the effective date of any changes indicates your acceptance of the updated terms.
